APPLICATION FOR A PERMIT TO CONDUCT TRADE
OR COMMERCE IN A PARK OR RESERVE:
TOUR OPERATOR PERMIT

In accordance with by-law 13 of the Territory Parks and Wildlife Conservation By-laws (By-laws), a person must not carry on trade or commerce in a park or reserve without a permit issued by the Parks and Wildlife Commission of the Northern Territory (Commission). Trade or commerce includes the conduct of a tour, safari or excursion in any park or reserve (tours). In this application we refer to a permit to conduct tours (carrying on trade or commerce) in a park or reserve as a tour operator permit.
A person wanting to apply for a tour operator permit should complete this application form and submit it to the Commission. (Further instructions about completing this form are set out in the 'How to complete this form' section below)
The Commission has discretion to decide whether to grant a tour operator permit in accordance with by-law 13. Without limiting that discretion, the Commission will generally only grant a permit if:
(a) the commercial activity is consistent with any management plan for any park or reserve;(b) the commercial activity is not likely to, within any park or reserve:
(i) endanger public safety;
(ii) damage any natural features;
(iii) interfere with the preservation or conservation of flora and fauna or heritage objects or places;
(iv) interfere with the protection of other features or facilities;
(v) interfere with the use of the park or reserve by any traditional Aboriginal owners of the park or reserve, including for cultural events and practices; or
(vi) interfere with the enjoyment of any park or reserve by other persons;
(c) the applicant for the permit and any employee, agent or contractor who will be involved in carrying on the commercial activity:
(i) has not been found guilty of an offence against the Territory Parks and Wildlife Conservation Act (the Act), or the By-laws or another law of the Northern Territory, the Commonwealth or a State or Territory that relates to the protection, conservation or management of native species;

(ii) have not previously breached the terms or conditions of a permit granted by the Commission under the Act or the By-laws;
(iii) have not previously engaged in any conduct which has resulted in a risk or potential risk to the health and safety of any other person at a park or reserve; and
(iv) have not been found guilty of an offence against the Work Health and Safety (National Uniform) Legislation Act relating to health and safety or any other law of the Commonwealth, a State or Territory that relates to health and safety.
(d) the Commission is satisfied that it is appropriate to grant a permit to the applicant.
In most cases, a tour operator permit will enable the permit holder to conduct tours in all parks and reserves managed by the Commission, except:
Channel Point Coastal Reserve; andGarig Gunak Barlu National Park.
While a tour operator permit will enable the permit holder to conduct tours in Nitmiluk (Katherine Gorge) National Park and Tjorita/West MacDonnell National Park and Alice Springs Telegraph Station Historical Reserve, a tour operator permit does not allow the permit holder to conduct tours on:
the Jatbula Trail in Nitmiluk (Katherine Gorge) National Park; or the Larapinta Trail within Tjoritja / West MacDonnell National Park and Alice Springs Telegraph Station Historical Reserve.
Any tour operator permit will be granted subject to specified terms and conditions. The applicant will be required to obtain and maintain the following insurances for the duration of any permit:
1. public liability insurance including personal injury, death and property damage arising out of the applicant's activities on any park or reserve for at least twenty million dollars ($20,000,000) per event;
2. workers compensation insurance as required by law; and
3. insurance sufficient to cover the property owned or used by the applicant in connection with the applicant's activities on any park or resrve.
Duration of Tour Operator Permits
Tour operator permits may be issued for a minimum of one year, up to three years or up to five years from date of issue.
Payment of the Tour Operator Permit
A fee is payable for the issue of a tour operator permit in accordance with by-law 13(5). The amount of the fee depends on the number of tours you will conduct in parks and reserves in any year.
If you will conduct a maximum of four park visits in a year, the fee is $100.00. If you will conduct five or more park visits in any year of your tour operator permit, the fee is $500.00 for each year.
All permit fees are payable to the Commission in one lump sum at the time of submitting the form.

NOTE: Tour Operator permits do not permit commercial activities within Garig Gunak Barlu National Park (Cobourg), Channel Point Coastal Reserve, the Larapinta Trail and the Jatbula Trail. Permit Holders must contact the Permits Office prior to conducting any tours within these areas and obtain appropriate permits as vehicle/number restrictions and camping fees apply for these areas.
