Standard Conditions for all TMR Applications
1) The signatory (Nominated Representative) warrants that he/she is authorised to sign for and apply on behalf of the Applicant.
2) No activities shall commence until an approved signed traffic control permit (TCP) is issued and received by the applicant. Traffic Control Permits issued to the Applicant are non-transferrable.
3) The Applicant and the Applicant’s delegates or persons acting on the Applicant's behalf will comply with all permit conditions.
4) The application must be completed in full and submitted with all mandatory documents. Incomplete or incorrect applications will not be processed within the published timeframes, as the application may be rejected or further information requested.
5) All aspects regarding safety of the public (including motorists) and to workers is the responsibility of the Applicant/Client/Principal Contractor/PCBU.
6) The Applicant will ensure communication is conducted with parties directly affected by the works including residents or businesses to ensure they are informed of the upcoming works and potential impact to them. For example, if undertaking works at night or temporarily altering access arrangements, this may include letterbox drops or a door knock prior to works.
7) The Applicant is responsible for advising public transport operators and patrons prior to and during the works. This includes obtaining approval and providing alternatives if the proposed works close or alter access to public transport operations including bus stops. For example, installing temporary signage on affected bus stops 7 days prior to works.
8) The Applicant has nominated a single point of contact who will be available by mobile telephone for the duration of the works.
9) The State of Queensland, acting through the Department of Transport and Main Roads, is indemnified by the Applicant in writing against any claim whatsoever arising out of or in any way connected with the application or the carrying out of the Applicant's works by Deed of Indemnity in a form approved by TMR.
10) The Applicant is to be registered with the Traffic Management Registration Scheme (TMRS) in accordance with the TMRS requirements.
11) The Applicant agrees that lanes will not be used for stockpiling of material unless otherwise specified by TMR in advance.
12) The Applicant is aware that TMR has reserved the right to amend or retract its approval at any time should variance of the stipulated conditions occur;
13) The Applicant acknowledges that TMR may undertake an official audit of traffic control on site, using information provided as part of this application.
14) The Applicant acknowledges that there will be no closures or traffic control on event days, as listed in the Traffic Permit Supporting Information document (Clause 3.1.2).
15) Emergency Services are to be notified of the traffic control arrangements.
Standard Conditions for all TMR Traffic Permits
1) The Applicant must notify the traffic management centre responsible for the area your traffic control is affecting by telephone at the following times below:
Brisbane Metropolitan Transport Management Centre (BMTMC), Brisbane – (07) 3292 6095,
State-wide Traffic Management Centre (STMC), Nerang - (07) 5561 3800 or
North Coast Traffic Management Centre (07) 5313 8737:
a) One hour prior to implementation of the Traffic Guidance Scheme;
b) In event traffic delays exceed five (5) minutes or 500m, whichever is the lesser.
c) Immediately that there is any unexpected disruption to traffic or a traffic incident at or near the site
d) Immediately prior to departure of site after all traffic control devices are removed;
2) The decision of TMR to issue a permit is not an endorsement or approval of the safety or effectiveness of the traffic guidance scheme (TGS) or works being undertaken and does not imply that the TGS or associated works comply with any or all applicable laws, regulations, by-laws, codes, standards, guidelines or manuals. TMR disclaims any responsibility or liability that may arise from or in connection with the TGS and supporting documentation submitted by the applicant. TMR may conduct on-site audits of any TGS periodically, at the discretion of the department.
3) The affected state-controlled roads and surrounding traffic flow is to be monitored and should significant queuing occur (greater than 500m or 5 minutes), the lane closures or traffic controller shall be cleared to let traffic through before resuming work.
4) This permit for traffic control does not constitute agreement to alter traffic control or regulatory devices after leaving site, other than those previously agreed in writing with TMR.
5) All impacts/changes (including short term traffic control) outside the state controlled road network are to be approved by the respective authority with responsibility for the management and control of the area (including, but not limited to, local government and other road authorities) prior to works commencing.
6) A general police permit is to be obtained from the Queensland Police Service, where required by QPS.
7) Traffic control devices are to be implemented and recorded in accordance with the provisions of Part 3 of the Queensland Manual of Uniform Traffic Control Devices (current edition).
8) Location of temporary or trailer Variable Message Signs (VMS) on state controlled roads and facilities are to be such that they are not a hazard to traffic or road users (including pedestrians and cyclists) or do not increase the crash severity if impacted by an errant vehicle or road user. The applicant 's is to ensure locations are in compliance with one of the following:
a) Trailers are outside the clear zone for the speed environment as specified in the Queensland TMR Road Planning and Design Manual; or
b) Trailers are protected by a suitable barrier (including outside the deflection zone) in accordance with the Queensland TMR Road Planning and Design Manual and manufacturer’s specifications; or
c) A risk assessment is undertaken by a competent person, in accordance with Part 3 of the Manual of Uniform Traffic Control Devices (Qld) and Australian Standard 4360.
9) TMR does not accept any responsibility for damage to or repair work resulting from activities carried out by the Applicant or any person acting on behalf of the Applicant.
10) Following completion of Works, the road is to be left in a neat and tidy manner, suitable for the posted speed limit.
11) The conditions stated in this permit from TMR shall not be interpreted as agreement by Local Government or any other government department, service authority, private property owner, lease holder and so on. Likewise, agreement by another entity shall not be interpreted as agreement from TMR.
12) A copy of the Traffic Guidance Scheme/s and permit/s must be available at the work site during traffic management and provided to Queensland Police Service or a TMR representative upon request.
13) The permit grants permission for the installation of temporary traffic control on the nominated road work site only and does not negate the need for the applicant/Client/Principal contractor/PCBU to have all other necessary approvals. Failure to obtain such approvals and / or meet the conditions of such approvals will result in the immediate cancellation of the permit.
